Bombay HC Criticizes State and SRA for Delays in Wadala Redevelopment Project

The Bombay High Court has expressed strong disapproval of the State government and the Slum Rehabilitation Authority (SRA) for their failure to resolve the stalled redevelopment project in Wadala (E). This project has left occupants without their promised permanent accommodation or transit rent since 2013, leading to the court's stern rebuke.

Background of the Wadala Redevelopment Project

The redevelopment project in Wadala has faced significant delays, primarily affecting the residents who vacated their premises in 2013. Justices Mahesh Sonak and Kamal Khata highlighted the plight of these occupants, stating that they are neither close to receiving their promised permanent accommodation nor any transit rent. The court's remarks came during a hearing of a petition filed by 20 members of Shaikh Misree SRA CHS.

Developer's Financial Difficulties

Omkar Realtors and Developers Pvt Ltd, the original developer of the project, ceased payments for transit rent in 2015/2016, citing financial difficulties. As a result, the rehabilitation building work has yet to commence, leaving the occupants in a precarious situation. The court's criticism extends to the developer's reluctance to address the financial obligations owed to the residents.

Proposed Change of Developer

During a previous court session, the SRA informed the judges that J C Flowers Asset Reconstruction Pvt Ltd had submitted a proposal to take over the project, which includes assuming Omkar’s assets and liabilities. However, the lender’s advocate clarified that this proposal was limited to a change of the developer and did not address the immediate concerns of the residents regarding their transit rent and accommodation.

Court's Directives and Implications

The judges emphasized that the petitioners are entitled to transit rent and should not have to navigate bureaucratic hurdles to recover their dues. They criticized both the developer and the lender for their unwillingness to settle the arrears and condemned the State and SRA for their inaction. The court's remarks underscore the urgency of the situation, as it noted that none of the involved parties seem serious about resolving the residents' pressing issues.

Market Context in Wadala

In the backdrop of this legal turmoil, Wadala currently has 86 active sale listings with a median asking rate of about ₹37,100 per sq ft carpet. This figure reflects the ongoing interest in the area, despite the challenges posed by stalled redevelopment projects.

Practical Takeaway

For homebuyers, tenants, and investors in Wadala, the ongoing legal issues surrounding the redevelopment project highlight the importance of due diligence when considering properties in this locality. The situation serves as a reminder of the potential risks associated with projects that are stalled or facing legal challenges, and the necessity for clear communication and accountability from developers and authorities.
